MOTHERS DAY 2017 UK FITBIT FACEBOOK COMPETITION TERMS AND CONDITIONS Your Chance to win a NEW Fitbit Alta HR! (“Prize Draw”) The following Prize Draw is intended for United Kingdom (“UK”) residents and shall only be construed and evaluated according to English law. Please do not enter this Prize Draw if you do not, or cannot, comply with entry criteria detailed below. The promoter of this Prize Draw is Fitbit International Limited of 76 Lower Baggot Street, Dublin 2, Ireland (the “Fitbit”) 1. ELIGIBILITY: The Prize Draw is open only to legal residents of the UK who are: (a) age 18 or older; (b) are resident in the UK during the Entry Period (defined below); and © have entered the Prize Draw as set forth below (“Entrants”). Employees, contractors, directors and officers of Fitbit and agencies associated with their subsidiaries, distributors, and the advertising, fulfillment, judging and promotion agencies and persons involved in the administration, development, promotion and execution of this Prize Draw (collectively, “Prize Draw Parties”), and their immediate family members (spouse, parent, child, sibling and spouse of each) and those living in the same households of each are not eligible for the Prize Draw. Void outside the UK. 2. ENTRY PERIOD. The Prize Draw will begin on MARCH 18TH, 2017 at 09:00 AM GMT and will end on MARCH 25TH, 2017 at 11.59 PM GMT (the “Entry Period”). 3. TO ENTER: To enter this Prize Draw, Entrants must do the following: (ii) Click on the Facebook URL set forth at facebook.com/FitbitUKIreland; (ii) Upload a photo of your Mum; and (iii) Include a caption with your photo telling us why you love your Mum, why she deserves to win a new Fitbit Alta HR and the hashtag #loveMum. ​(collectively, an “Entry”). All Entries must be received by Fitbit during the Entry Period. Any Entries made after this time will not be accepted. THERE MAY ONLY BE ONE (1) ENTRY PER PERSON. MULTIPLE ENTRIES BY THE SAME INDIVIDUAL USING DIFFERENT FACEBOOK ACCOUNTS MAY DISQUALIFY THE ENTRANT AND ANY OF HIS/HER ENTRIES. Automated entries are prohibited, and any use of automated devices will cause disqualification. 4. ENTRY REQUIREMENTS/CONDITIONS: Entries which are incomplete, incorrect, incomprehensible, not received, or do not otherwise comply with these Terms and Conditions will not be entered into the Prize Draw. By submitting an Entry, you acknowledge and agree that your name, image, town, county or country may be posted on Fitbit’s websites and social media sites, that your submission is gratuitous and made without restriction, and that your Entry will not place Fitbit under any obligation outside of these Terms and Conditions. Entries must not infringe third-party rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; cannot be sexually explicit or suggestive, profane or pornographic, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; cannot be offensive, endorse any form of hate or hate group; cannot defame, misrepresent or contain disparaging remarks about Fitbit or its products, or other people, products or companies; cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Fitbit wishes to associate; may not invade privacy or other rights of any person, firm or entity; may not in any other way violate any applicable law or regulation; may not contain any reference to any third party trademarks, names or third party logos (other than as owned by or licensed to the Entrant) or any copyrighted components (other than as owned by the Entrant); and cannot contain any personal identification, such as licence plate numbers, personal names, e-mail addresses or street addresses. Entries containing any such prohibited content and/or otherwise deemed by Fitbit, in its sole discretion, to be inappropriate will be disqualified. Fitbit makes the final determination as to what Entries are eligible to take part in this contest. Entrant agrees that by submitting the Entry, Entrant will obtain the necessary consent from any third parties who are included in the Entry. 5. WINNER SELECTION: Fitbit and/or its designee(s) will select: (a) one (1) first place winner at random from all eligible Entries who will receive two (2) Fitbit Alta HR and two (2) accessory wristbands (“First Place Winner”); and (b) three (3) runners up at random from all eligible Entries who will receive (1) Fitbit Alta each (each individual, a “Runner-Up”). Selection of First Place Winner and Runners-Up will occur at Fitbit’s place of business made by a random number generator after March 25, 2017. Chances of being selected as the First Place Winner or as a Runner-Up are dependent on the total number of Entries received. Becoming the First Place Winner or a Runner-Up is subject to validation and verification of eligibility and compliance with these Terms and Conditions. The First Place Winner and Runners-Up will be notified via Facebook private message and follow up prize correspondence will take place through postal mail or e-mail. Fitbit is not responsible for any change in the Entrant’s mailing address, or email address. If any prize correspondence (including e-mail) is returned as non-deliverable, or if the First Place Winner or a Runner-Up is otherwise disqualified for any reason the prize will be forfeited and an alternative First Place Winner or Runner-Up will be selected. In the event an alternative First Place Winner or Runner-Up is selected, such First Place Winner or Runner-Up will receive the Prize described below. 6. PRIZE: There are seven (7) prizes available in this Prize Draw. The one (1) First Place Winner will receive 2 Fitbit Alta HR (large or small, in the color of their choosing) which equals an approximate retail value of UK £129.99 each and two (2) accessory wristbands (which shall not include the Metal Bracelet) which equal an approximate retail value of £19.99 each. The three (3) Runners-Up will receive one (1) Fitbit Alta (large or small, in the color of their choosing but excluding the Special Editions or leather accessory bands) which equals an approximate retail value of £99.99 each. Fitbit Alta accessories are not included in the runner up prize. No substitution, cash redemption or transfer of prize is permitted except at Fitbit’s sole discretion. 7. GENERAL CONDITIONS: The prize will be awarded only to an address within the UK. By participating, Entrants agree to these Terms and Conditions, and to the Fitbit’s decisions, which are final and binding in all respects. Prize Draw Parties assume no responsibility for lost, late, misdirected, stolen, mutilated, illegible, undelivered, garbled, damaged, incomplete Entries, or for any computer, online, or technical malfunctions that may occur. Prize Draw Parties also assume no responsibility for any technical problems in connection with transmission or receipt of online Entries including faulty electronic data transmission, traffic congestion on the Internet or on the web site, hardware or software error, equipment failure or malfunction, or other online communications problems. If for any reason the Prize Draw is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Prize Draw, Fitbit reserves the right, at its sole discretion, to disqualify any Entrant who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Prize Draw and select at random a Winner from all eligible Entries received prior to the cancellation or termination. This Prize Draw is governed by the laws of England and Wales whose courts shall have exclusive jurisdiction in respect of any dispute relating to the Prize Draw. 8. LIMITATIONS OF LIABILITY AND RELEASE: By entering, Entrants agree (and agree to confirm in writing) that, so far as the law allows, that the Prize Draw Parties and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Prize Draw; from acceptance, possession, misuse or use of any prize; or from participation in any prize-related activity.
